Property may be removed by appointment only and appointments must be made at least 24 hours in advance. All items must be removed within ten (10) business days from the time and date of issuance of the Buyer's Certificate.

The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. No Assistance will be provided. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer's Certificate. THE REMOVAL OF THE PURCHASED ASSETS FROM THE VENDOR’S PREMISES SHALL BE THE SOLE RESPONSIBILITY OF THE PURCHASER. The winning bidder will be contacted by a Hamilton-Wentworth District School Board representative to arrange pick of the asset. Pick up availability - Monday to Friday during business hours. Asset pick up address (within City of Hamilton) will be supplied upon close of auction to the winning bidder. If using a third-party carrier for Pickup - PLEASE provide them with a copy of the Buyers Certificate, and ensure they are included on ALL email correspondence concerning pickup directions,location AND time. The seller:
will not be held responsible for any damage to any items during removal.
will not provide any labour assistance with removal.
will not sign any document for shipping.
will not recommend any shippers, freight forwarders, couriers or delivery services.
will not be responsible for any shipping, delivery, duties, import fees, taxes or any other charges.
will not supply any asset information required for customs.
will not be responsible for preparing any documentation foreign or domestic.

Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' Hamilton-Wentworth District School Board. THE VENDOR MAKES NO REPRESENTATIONS, WARRANTIES OR GUARANTEES IN RESPECT OF THE PURCHASED ASSETS AND THE PURCHASER ACCEPTS THE PURCHASED ASSETS ON AN AS-IS AND WHERE-IS BASIS, WITH ALL FAULTS, AND WITHOUT RECOURSE, IRRESPECTIVE OF CONDITION, WEAR OR DAMAGE.THE VENDOR HEREBY DISCLAIMS ANY AND ALL OTHER WARRANTIES, EITHER EXPRESS, OR IMPLIED, BY FACT OR BY LAW, INCLUDING BUT NOT LIMITED TO REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR THE ORDINARY OR ANY PARTICULAR PURPOSE, THE CONDITION, DESIGN, CONSTRUCTION, QUALITY, ACCURACY OR COMPLETENESS OF ANY PURCHASED ASSETS, AND THE RESULTS OF ANY FUTURE OPERATIONS, SALES OR OTHER ECONOMIC PERFORMANCE OF ANY PURCHASED ASSETS. NO CLAIM SHALL BE MADE BY THE PURCHASER RELATING TO OR ARISING FROM THE CONDITION, OPERATION, USE, DESIGN, CONSTRUCTION, ACCURACY OR COMPLETENESS OF ANY PURCHASED ASSETS OR FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING THEREFROM (INCLUDING BUT NOT LIMITED TO ANY PRODUCT LIABILITY CLAIMS).

Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.
